Pakistani woman abused by a UK civil servant in mortgage case inquiry

ISLAMABAD/LONDON: In the UK’s biggest mortgage fraud probe, a Senior UK civil servant working for Serious Fraud Office (SFO) made a British Pakistani woman a target of verbal abuse, and also insulted another ethnic female lawyer calling her a “dog”.

The senior civil servant Jonathan Francis McGarry a lead lawyer within the Proceeds of Crime and International Assistance Department at the SFO, called the Pakistani woman named Shabana Kausar a “gangster’s moll” in presence of the witnesses in court.

McGarry’s attack at Shabana Kausar, the ex-wife of British Pakistani businessman Nisar Afzal, was without any provocation.
After 15 years of investigation, Serious Fraud Office has now dropped the criminal fraud investigation into Nisar Afzal. At the request of the SFO, restraining orders and arrest warrant were cancelled through the Southwark Crown Court against Nisar Afzal who left for Pakistan in 2006 denying any wrongdoing.

According to papers, Shabana Kausar’s lawyers at Imran Khan and Partners made a formal complaint to the SFO against the civil servant. The SFO investigated and found that McGarry was actually involved in the abuse. The SFO disciplined Mr McGarry and separated him from the case file of Afzal family members but the lawyer then quietly returned to the case.

Legal papers show that Jonathan Francis McGarry referred to Shabana Kausar as a “gangster’s moll” at the Westminster Magistrates’ Court on 28 February 2020 in the course of post hearing discussions held with the counsel Christopher Convey and Jayne Edwards, the Principal Financial Investigator in the case.

Shabana Kausar’s lawyer at Imran Khan and Partnerships wrote that the extremely offensive comment was “unwarranted, unprofessional and highly offensive, particularly as it came from a member of the prosecution agency” targeting a female who has suffered violence.
Imran Khan and Partners also reported in the same complaint to SFO that Jonathan Francis McGarry attacked another professional woman related to the same case. On 20 October, McGarry sent email to Ghislaine Sandoval, a trainee solicitor, saying: “At least Ghislaine has got a training contract now and isn’t merely a dogs body.”

The complaint to SFO said the attack from Mr McGarry was a “serious breach of the SRA principles 2 and 5” as solicitors must “act in a way that upholds public trust and confidence in the profession and in legal integrity. We don’t know why MG chose to compare a female trainee solicitor of this firm to a dog”.

The lawyer questioned that irrespective of Mr McGarry’s motives and the professional and disciplinary matters his conduct arises, his behaviour also gave rise to a serious concern as to how this matter was being prosecuted.

The lawyers complained to SFO on 26 august 2020 that Mr McGarry wrote to Southwark Crown Court accusing Shabana Kausar’s son Akash Afzal of attempting to sell a property known as Turtle Creek, Florida, USA, in breach of the court orders. The lawyers told SFO that he had misled the court because both the US Department of Justice and lawyer of Akash refuted the allegation as false.

The lawyers told SFO they were making complaint after a number of incidents over a period of time led to concerns regarding Mr McGarry’s professionalism and his regard to the Rules of Conduct in prosecuting the case against Nisar Afzal, Saghir Agzal and their family members.
The legal papers state that on 29 January 2021, the SFO confirmed in writing it’s investigation upheld two complaints in relation to Shabana Kausar and Ghislaine in that the comments were made and were inappropriate.

The SFO said that “as a result we have taken the action” and Mr McGarry “is to have no further direct contact with you or your colleagues”. The SFO told lawyers it had encouraged Mr McGarry to apologise but neither any apology was given nor Mr Mcgarry stayed away from the case after his attack on two women.

Official papers show that Jonathan Francis McGarry is running the case against although SFO had taken him off the case over complaints by the Afzal family.

Sheth Jeebun leading from the front in UK’s Health Care

During the Pandemic United Kingdom also faced the wrath of Covid-19, we interviewed Sheth Jeebun who is Managing Director of Aster Healthcare Ltd. He was born and bred in the lovely island of Mauritius. He did O/A Level from Cambridge and then got registered as Nurse Training in 1987, after completing his training he started working as registered as Nurse and then as ward manager in 1989.

From 1990- 2005 he is established 3 Nursing Homes for the Elderly and since
2006 to date he is the Director of Aster Healthcare (group of Nursing homes) and Property developments.

With over 30 years of experience in the healthcare sector at all levels, he is a seasoned and dedicated healthcare professional, who is committed to providing the highest quality of care for the elderly. He has worked from the bottom as a nurse for the elderly and gradually enhanced his skills to managing nursing homes, thus, he knows how the intricacies of care at all levels of the industry. Furthermore, he also has many years of experience in property development.

Talking to Dailytimes Sheth Jeebun said “I recognise the importance of sustainability in mitigating the impacts of over-consumption and carbon use. I am therefore committed to making all Aster Healthcare Homes completely paper-free by 2020. To do so we are investing in the latest technology that provides unparalleled care management systems for the tailored treatment of our residents. Such digitisation will not only provide for more efficient and accurate care but will also reduce our carbon footprint as a company.

Aside from the care sector, I am also involved in several international investment projects. In early 2022 we are starting a project in India in the Artisan Sector which would include working with 30,000 skilled, deprived women in the rural areas. The aim of the project is to bring artisan products by underprivileged women in the rural areas of India to the UK market so that they may earn a living for themselves and free themselves from situations of financial difficulty. Equally, I am currently undertaking an investment project in Mauritius that is looking to covert undeveloped land into a housing, hotel and shopping complex.

A key part of my ethos is giving back to the community and ensuring that I help those around us who are less fortunate. The pandemic of the last several years has truly highlighted inequalities that exist globally and I am incredibly proud to say that I have been involved in sponsoring underprivileged children across the world in Africa, Pakistan and India since the 1990s and will continue to do so. As a firm we are also involved in being a corporate sponsor for several local charities including Plan International, Red Cross, Action Aid, in Aid of Care, Dignity in Care, Guildford Philanthropy among many others.

My Vision over the next few years is to see stable growth across all our divisions whilst committing to making the way we work more sustainable and friendly to the planet.

Ex-employees at Salt Bae NYC file labor lawsuit for discrimination

Two former employees of a Manhattan steakhouse owned by famed Turkish chef Nusr-et Gökçe — better known as “Salt Bae” — have each filed $500,000 lawsuits claiming that Turkish workers were treated better at the restaurant than they were because they’re Hispanic.

Waiter Angelo Maher and bartender Elizabeth Cruz said they were discriminated against working at Nusr-et Steakhouse New York because they weren’t Turkish, according to lawsuits filed against the chef’s company last week in Manhattan Supreme Court.

Maher — a Peruvian who started working there in 2017 — claims he was regularly put in less lucrative sections of the restaurant than Turkish employees were and that they were protected by management even if they had poor performance or misconduct.

Maher also said in his suit that he — and other non-Turkish workers — were kept in the dark about how they paid out the tip pool at the restaurant.

Maher confronted a manager about it and was told “Stop with this tip-pool stuff cause I’m telling you, you are on your final warning, just stay neutral,” the suit alleges.

The waiter said he was forced to forgo tips when he served Gökçe’s celebrity friends, including rapper French Montana.

And, when Maher was asked by guests whether the steakhouse’s meat was Halal — food permitted under the Islamic religion — he claims he was told to lie to guests telling them that it was, “despite the fact that this claim was not true,” according to the court documents.

Maher also says he had to pay out of pocket to cover his mistakes on guests’ orders, while Turkish employees didn’t, the filing claims.

Maher raised his concerns over the alleged discrimination to Human Resources in September 2019 but was retaliated against after, the suit claims.

Following the complaint, Maher said he would be sent home early on his shifts and was given less lucrative sections of the restaurant to serve in and that he was twice manhandled by Turkish employees, including once being slapped by his manager, the filing alleges.

Maher was fired in March 2020 and when the eatery opened back up after the earliest days of the coronavirus pandemic that he wasn’t rehired like other employees were, the suit claims.

In a separate suit, Cruz — whose family background is Dominican — says she was hired in April 2019 and soon after was sexualized in a way that Turkish women workers and other male employees weren’t.

In particular, Cruz came in with the normal uniform but was told to go home and change into “a short skirt, high-heels and a revealing top,” the filing alleges.

The manager told her “My wife is Dominican, I know how you women are” and that “was suggesting that Ms. Cruz was sexually promiscuous due to her heritage,” the suit charges.

A few weeks later, Cruz asked the manager if she could go back to wearing the standard uniform because she felt degraded and was physically uncomfortable in the other one. She was fired a few days later, the filing claims.

A lawyer for Gökçe’s company did not immediately return requests for comment and a message left at the restaurant was not immediately returned.

Gökçe has been named in other suits including ones alleging he stiffed workers on tips and overtime pay. He was also named in a $5 million copyright infringement lawsuit for allegedly using an image from a commissioned artwork on marketing materials worldwide without paying for the additional uses.

The first two were settled while the copyright infringement suit is still pending.
